GROUNDS OF FACT / GROUNDS OF LAW.

The Spanish National Markets and Competition Commission (CNMC) in 2015 recognised via 2 Resolutions that 26 car brands and more than 100 authorised dealers had exchanged confidential information with the aim of increasing their margins and controlling the prices of the motoring market, behaviour which colloquially called “cartel”.

These anti-competitive actions broke the Regulations on competition in its art. 101 (Art.101 of the Treaty on the Functioning of the European Union), consequently the Trademarks and Car-Dealers were financially sanctioned. Many of the Trademarks appealed before the National High Court and since 2020 the Supreme Court Administrative Chamber dismissed them firmly.

Those natural persons and legal entities who have purchased a vehicle/s of the Brands outlined within the period [febrero 2006 a mayo 2013] with some exceptions.
